Terms of Service
Effective October 2, 2026
These Terms of Service govern access to and use of OperSimple, a software platform for service businesses and their authorized workers. By using OperSimple, you agree to these terms.
1. The service
OperSimple provides tools for scheduling, customer records, team coordination, job updates, invoicing, payments, reporting, and customer communications. OperSimple is a software platform only. Services such as cleaning, handyman, landscaping, or other work are provided by the business using the platform, not by OperSimple.
2. Accounts and authorized use
Businesses are responsible for providing accurate account information, protecting credentials, and authorizing only appropriate users. You must use the service lawfully and must not attempt to access another business's data, interfere with the service, or use the service for fraudulent, abusive, or unsolicited activity.
3. Customer communications and SMS
Businesses may use OperSimple to send customer messages only when they have a lawful basis and the customer's required consent. Messages may include appointment updates, service notifications, invoice or payment-link notifications, and replies to customer questions. Message and data rates may apply. Recipients can reply STOP to opt out and HELP for help. Businesses must honor opt-out requests and are responsible for the content, timing, recipients, and regulatory compliance of their messages.
4. Payments and third-party services
Payment processing, messaging delivery, hosting, and other integrations may be provided by third parties and are subject to their terms. OperSimple does not store payment card details when a third-party payment processor handles them. Businesses remain responsible for their prices, invoices, refunds, taxes, and obligations to their customers.
5. Content and data
You retain responsibility for the information and content you enter or upload. You grant OperSimple permission to process that content as needed to provide, secure, support, and improve the service. Businesses are responsible for having the rights and notices required for customer, employee, photo, and messaging data they provide.
6. Availability and changes
We work to keep OperSimple available and secure, but do not guarantee uninterrupted or error-free operation. We may modify the service or these terms as the service evolves. We will post updated terms at this URL and revise the effective date.
7. Suspension and termination
We may suspend or terminate access for violations of these terms, unlawful or harmful activity, nonpayment, or security reasons. You may stop using the service at any time. Provisions concerning payment obligations, data responsibilities, acceptable use, and limitations continue as applicable after termination.
8. Disclaimers and liability
To the extent permitted by law, OperSimple is provided without warranties beyond those expressly stated. OperSimple is not responsible for the quality, safety, legality, or completion of services offered by businesses using the platform, or for third-party provider outages. To the extent permitted by law, OperSimple will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the service.
